騎樓有兩種.. .一種是路權屬於市民的，為道路的一部份，不是大樓說怎樣就怎樣的。

一般臨著大路要道的騎樓，為「法定騎樓」，於法定騎樓上路權是市民的(產權是私有的)，既非大樓公設亦非私人專用～路權為市民所有，法定騎樓可不可以停放機車，要看地方政府的規定~例如：騎樓停機車管理辦法～能停時大家都可以停，不能停時，大樓住戶也不能停放。所以：他拍他的照片，罰不了你的，而且用血來污損你的機車...你還可以告他「令你心生恐懼」，就是說：
『為維護本大樓各戶之權益已拍照存證』是騙小孩的啦，他們沒有辦法讓警察開珠罰單的啦 ！

另一種為「私設騎樓」，非法定騎樓的通通叫私設騎樓，產權私有，但可能是該大樓的約定公用，這種私設騎樓，警察也不會開罰單的，因其屬於私權範圍，道路交通安全處罰條例是管不到私權範圍的  。一樣是騙小孩的啦，
